The Health Insurance Portability and Accountability Act was signed in 1996. The legislation is divided into three different sections, each with different, though sometimes overlapping, goals. The legislations include a Transactions Rule, a Security Rule, and a Privacy Rule. The Transactions Rule was created with the simple goal of saving money. The means to reach this goal include standard electronic transactions; standard record formats, code sets, and identifiers; and standards around eligibility, referrals, claims and remittances. The Transactions Rule became a Federal Requirement on October 16, 2002. The Security Rule and the Privacy Rule are overlap in many respects. The Security Rule, which was recently finalized, is concerned with maintaining the integrity, availability, and confidentiality of Protected Health Information (PHI).

HIPAA, HCFA/CMS, and State Legislation

In some cases, broad national legislation like that mandated by HIPAA or CMS, may actually differ with your state laws; in such situations, the more restrictive law prevails. This is particularly true in the case of privacy laws, which sometimes may be buried in other types of statutes and case law. In many cases, state health departments and provider associations may have conducted or need to conduct an analysis to determine if a conflict exists.
